Terms of Service

These Terms of Service ("Terms") govern your access to and use of the CasaWise.ai web application and the CasaWise mobile applications (together, the "Service") operated by NestCalc.ai LLC dba CasaWise.ai ("CasaWise.ai," "we," "us," or "our"), a Wyoming limited liability company. Please read these Terms carefully before using the Service.

The Service is available as a website at casawise.ai and as mobile applications distributed through the Apple App Store and Google Play. Which payment, renewal, and refund terms apply to you depends on where you made your purchase: Section 4 covers purchases made on the CasaWise.ai website, and Section 5 covers purchases made through the Apple App Store.

1. Acceptance of Terms

By accessing or using the Service, creating an account, or subscribing to a paid plan, you agree to be bound by these Terms. If you do not agree to all of these Terms, you may not access or use the Service. Your continued use of the Service following the posting of any changes to these Terms constitutes acceptance of those changes.

2. Description of Service

CasaWise.ai is an AI-powered real estate investment analysis platform. The Service provides deal calculators, financial projections, market intelligence, macro economic dashboards, and AI-generated deal narratives to help users evaluate potential real estate investments.

The Service is offered across multiple tiers:

• Informed Homeowner - Free tier with core calculator functionality, FRED rate data, and basic projections.
• Pro AI Investors - $12/month or $120/year. Includes AI deal narratives, AI market intelligence, expandable market trend charts, short-term rental analysis, investment duration analysis, and unlimited PDF report export.
• Ultimate AI Investors - $18/month or $180/year. Includes all Pro features plus fix-and-flip and BRRRR modeling, additional income modeling, and saved deal comparison of up to ten deals.
• 24-Hour Ultimate Pass - $4 one-time purchase. Full Ultimate tier access for 24 consecutive hours, including unlimited PDF report export for the duration of the pass.
• 7-Day Ultimate Pass - $9 one-time purchase. Full Ultimate tier access for 7 consecutive days, including unlimited PDF report export for the duration of the pass.

The prices listed above are the prices for purchases made on the CasaWise.ai website. Pricing for purchases made inside our mobile apps is displayed in the app and on the app store listing at the time of purchase, and may vary by region and currency.

Features, pricing, and tier inclusions are subject to change. We will provide reasonable notice of material changes as described in Section 14.

3. Account Registration

To access certain features of the Service, you must create an account using a valid email address. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information to keep it accurate
• Maintain the security of your password and accept responsibility for all activity under your account
• Notify us immediately of any unauthorized use of your account
• Create and maintain only one account per person

We reserve the right to suspend or terminate accounts that contain inaccurate information or violate these Terms.

4. Subscription & Payment Terms - CasaWise.ai Website Purchases

This Section 4 applies only to subscriptions and one-time purchases made on the CasaWise.ai website. Purchases made inside the CasaWise iOS app are processed by Apple as in-app purchases and are governed by Section 5 below.

Paid subscriptions purchased on the CasaWise.ai website are processed through Stripe. By subscribing to a paid tier on the website, you agree to the following:

• Billing: Subscriptions are billed on a recurring monthly or annual basis, depending on the plan you select. The 24-Hour Ultimate Pass and the 7-Day Ultimate Pass are one-time purchases.
• Auto-Renewal: Monthly and annual subscriptions purchased on the website automatically renew at the end of each billing period unless you cancel before the renewal date. You may cancel at any time through the Stripe customer portal.
• Price Changes: We will provide at least 30 days' notice before any price increases take effect. The new price will apply at the start of your next billing cycle following the notice period.
• Payment Failures: If a payment fails, we may retry the charge and/or suspend access to paid features until the payment issue is resolved.

5. Purchases Made Through the Apple App Store

If you subscribe or make a one-time purchase inside the CasaWise iOS app, that purchase is an Apple in-app purchase. The following terms apply to it, and they govern over anything in Section 4 or Section 6 that would otherwise conflict with them:

• Processed by Apple, not by Stripe. Subscriptions and one-time purchases bought inside the iOS app are processed by Apple as in-app purchases. Stripe is not involved in those purchases, and we do not receive or store your payment card details.
• When you are charged. Payment is charged to your Apple Account at confirmation of purchase.
• Automatic renewal. Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours prior to the end of the current period.
• Managing and cancelling. Subscriptions purchased through the App Store are managed and cancelled in your Apple Account settings. They cannot be managed or cancelled inside the app or on the CasaWise.ai website.
• Refunds are handled solely by Apple. Refunds for App Store purchases are handled solely by Apple under Apple's policies and must be requested from Apple. The CasaWise refund policy described in Section 6 of these Terms applies only to purchases made on the CasaWise.ai website and does not apply to App Store purchases.
• Apple's terms also apply. App Store purchases are also governed by Apple's standard Terms of Use (EULA), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/.

Purchases made through Google Play are likewise processed by Google, are governed by Google Play's terms and refund policies, and are managed and cancelled in your Google Play account settings.

6. Refund Policy - CasaWise.ai Website Purchases

This refund policy applies only to purchases made on the CasaWise.ai website. Refunds for purchases made in the CasaWise iOS app are handled solely by Apple under Apple's policies, as described in Section 5, and must be requested from Apple.

Monthly & Annual Subscriptions

If you are not satisfied with a subscription purchased on the CasaWise.ai website, you may request a pro-rated refund within 7 days of your subscription start date or most recent renewal date. Refunds are calculated based on the unused portion of your billing period. After the 7-day window, no refunds will be issued for the current billing cycle; however, you may cancel to prevent future charges.

One-Time Purchases (Timed Passes)

One-time purchases made on the CasaWise.ai website, including timed passes, are eligible for a full refund within 24 hours of purchase. After 24 hours, those one-time purchases are non-refundable.

PDF Reports Are Not Sold Separately

PDF report export is included with the Pro and Ultimate tiers and with the timed passes. It is not sold on its own, so there is no separate charge for a PDF report and no separate PDF refund. If a report does not come out the way you wanted, you can generate it again at no additional cost.

How to Request a Refund

To request a refund for a website purchase, contact us at support@nestcalc.ai with your account email and a brief description of the issue. Website refunds are processed through Stripe and typically appear within 5-10 business days.

7. AI-Generated Content Disclaimer

The Service uses artificial intelligence technologies, including Perplexity Sonar (market intelligence), Anthropic Claude (deal narratives), and Google Gemini (macro economic dashboards), to generate analysis and content.

You acknowledge and agree that:

• AI-generated outputs are estimates and opinions, not guarantees of accuracy, completeness, or timeliness.
• AI may produce inaccurate, incomplete, or outdated information. AI models may "hallucinate" - generating plausible-sounding but factually incorrect statements.
• You are solely responsible for independently verifying all AI-generated data, projections, market analysis, and recommendations before relying on them for any purpose.
• CasaWise.ai is NOT a financial advisor, real estate agent, broker, appraiser, or licensed professional of any kind. The Service does not provide financial, legal, tax, or investment advice.
• AI outputs do not constitute a recommendation to buy, sell, hold, or finance any property.

8. Financial Disclaimer

All projections, calculations, and analyses provided by the Service are hypothetical and are based entirely on the inputs and assumptions you provide. They do not reflect actual investment results.

• Past performance does not guarantee future results. Historical data, trends, and market conditions referenced by the Service may not continue in the future.
• Real estate investments involve significant risk, including the potential loss of principal. Market conditions, interest rates, vacancy rates, property values, and operating costs can change substantially.
• You should consult with licensed professionals - including financial advisors, real estate attorneys, tax advisors, and real estate agents - before making any investment decisions.
• CasaWise.ai assumes no liability for any investment decisions you make or any financial outcomes that result from your use of the Service.

By using the Service, you acknowledge that you assume all risk associated with your investment decisions and that CasaWise.ai bears no responsibility for those outcomes.

9. Intellectual Property

The Service, including its design, code, algorithms, text, graphics, logos, and all other content created by CasaWise.ai (collectively, "Platform Content"), is the exclusive property of NestCalc.ai LLC dba CasaWise.ai and is protected by applicable intellectual property laws.

You retain all rights to the data you input into the Service (property details, financial assumptions, saved deals). We do not claim ownership of your input data. However, you grant us a limited license to process your data solely for the purpose of providing the Service.

AI-generated reports and narratives are produced using your inputs combined with our platform's AI integrations. You may use these outputs for your personal and business investment analysis. You may not resell, redistribute, or commercially license AI-generated outputs as a standalone product.

10. Acceptable Use

You agree not to:

• Scrape, crawl, or use automated tools to extract data from the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Access or attempt to access the Service's APIs, servers, or databases through unauthorized means
• Resell, sublicense, or redistribute data, reports, or analyses obtained from the Service
• Use the Service to develop a competing product or service
• Interfere with or disrupt the Service, its servers, or connected networks
• Impersonate another person or misrepresent your affiliation with any entity
• Use the Service for any unlawful purpose or in violation of any applicable laws

Violation of these terms may result in immediate account termination without refund.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• CasaWise.ai's total aggregate liability to you for all claims arising out of or related to the Service shall not exceed the total amount you paid to CasaWise.ai in the 12 months immediately preceding the event giving rise to the claim.
• IN NO EVENT SHALL CASAWISE.AI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to loss of profits, loss of data, loss of investment returns, or loss of business opportunities, regardless of the theory of liability.
• This limitation applies even if CasaWise.ai has been advised of the possibility of such damages and even if a remedy fails of its essential purpose.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

12. Dispute Resolution

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.

Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding individual arbitration, not in court. Arbitration shall be conducted under the rules of the American Arbitration Association (AAA) and shall take place in Wyoming or remotely, at the election of the claimant.

Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive the right to participate in a class action lawsuit or class-wide arbitration against CasaWise.ai.

Individual Claims Only

All claims must be brought in the parties' individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

Exceptions

Either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits. Either party may seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property rights.

13. Termination

By CasaWise.ai: We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

By You: If you subscribed on the CasaWise.ai website, you may cancel at any time through the Stripe customer portal accessible from your account settings. If you subscribed through the Apple App Store, you cancel in your Apple Account settings; if you subscribed through Google Play, you cancel in your Google Play account settings. Cancellation takes effect at the end of your current billing period - you will retain access to paid features until then. You may delete your account by contacting support@nestcalc.ai.

Upon termination, your right to use the Service ceases immediately (or at the end of your billing period for voluntary cancellations). Sections 7, 8, 11, and 12 of these Terms survive termination.

14. Changes to Terms

We may modify these Terms at any time. For material changes, we will provide at least 30 days' notice by updating the "Last Updated" date at the top of this page and, where appropriate, notifying you via email or an in-app notice.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and cancel your subscription.
